, Habiburokhman said the role of advocates in the Criminal Procedure Code (

) recently passed will resemble the role of advocate in American films.
According to Habib, the new KUHAP gives lawyers more authority and roles in legal assistance.This role, he said, was not regulated in the previous KUHAP.
“So we can imagine that in the future, our advocates will be like those in American films. They can debate with investigators to defend the interests of their clients,” said Habib in a speech reporting the results of the discussion of the Criminal Procedure Code at the DPR Plenary, Tuesday (18/11).

The Gerindra Party politician, for example, said that in the old Criminal Procedure Code, someone dealing with the law could only be accompanied by an advocate when they became a suspect.Meanwhile, in the new KUHAP, assistance by an advocate can be carried out from the start of the examination.
“Only when giving information can be accompanied by an advocate,” he said.
Then, in the old KUHAP, the role of an advocate when assisting was only to sit and take notes.Meanwhile, in the new KUHAP, advocates can raise objections and argue with investigators.
“And the objection must be accommodated in the BAP (investigation report),” he said.
Habib said that law enforcement officers would be able to use the new KUHAP starting January 2 2026. Habib admitted that his party had worked around it from the start so that this target could be realized.
Until that time limit, he continued, the old KUHAP was still in effect as long as it did not conflict with the new KUHAP.
“Ongoing criminal proceedings are still valid as long as they do not conflict with the Criminal Procedure Code,” he said.
