The Supreme Court ruling is a significant and rare setback for the Trump administration, which recently sought to use the National Guard to protect Immigration and Customs Enforcement (ICE) agents and assist ICE operations in various parts of the US.
This decision is also considered to be able to jeopardize the deployment of National Guard troops in US cities.
Professor at Georgetown University Law Center, Steve Vladeck, told

that this decision is a significant rejection of the Supreme Court against Trump’s efforts to use federal troops to assist ICE operations, especially in the jurisdiction of Democratic Party politicians.
“This is by far the most significant defeat the Supreme Court has handed Trump so far this year,” he said.
In federal law, the president is permitted to federalize National Guard troops when he can no longer enforce the law with “regular troops.”
Debate has arisen over whether the term “regular forces” refers to the regular military or federal agents, such as those working for ICE.
The court itself considered the term regular troops “likely” to refer to the military. The court also said the law Trump referred to appears to only apply when the military is on duty.
In other words, the law cannot be used to protect and assist ICE agents.
The White House has responded to the Supreme Court’s decision.White House spokeswoman Abigail Jackson said in a statement that this ruling will not stop the administration’s efforts to enforce immigration laws and protect federal personnel and the American people.
“He activated the National Guard to protect federal law enforcement officers, and to ensure rioters did not destroy federal buildings and property,” Jackson told

“There is nothing in today’s ruling that detracts from that core agenda,” he continued.
