“The termination of prosecution through RJ was approved because it had fulfilled the requirements stipulated in the Republic of Indonesia Prosecutor’s Regulation Number 15 of 2020, including a criminal threat of no more than five years,” said Didik.
The suspects were charged with Article 170 paragraph (1) of the Criminal Code concerning beatings or Article 351 paragraph (1) in conjunction with Article 55 paragraph (1) 1 of the Criminal Code concerning assault.
“The suspects are first-time criminals and are not recidivists. There has been unconditional peace witnessed by parents, community leaders and religious leaders,” he explained.
Didik added that the RJ application was submitted as an effort to resolve the case outside of court which is expected to be able to restore the situation while providing a deterrent effect through social sanctions.
“Resolving the case through RJ for the case in Rantepao not only stops the prosecution, but also ensures restoration of relations and social responsibility through sanctions for cleaning places of worship,” he concluded.
