The International Criminal Court (ICC) rejected the appeal submitted
Israel
so that the Prime Minister
Benjamin Netanyahu
not arrested.
In a ruling issued on Monday (15/12), the ICC judges stated that the ICC’s initial investigation, which opened in 2021, had covered all incidents related to the Gaza conflict, even since June 13 2014, so there was no need for a new notification or termination of the process.

“There are no substantial changes to the parameters of the investigation that require a new notification,” the ICC judge was quoted as saying

This ICC decision responds to Israel’s argument that the October 7 2023 conflict is a “new situation” that must be stopped or separated from the ICC’s initial investigation.
However, the ICC is of the view that there are no new circumstances that require prosecutors to restart the process or issue a new notification to Israel.
The appeals panel ruled that the investigation carried out since October 2023 concerned “the same type of armed conflict, involving the same territory, with the same parties allegedly involved in the conflict”.The appeals panel emphasized that this war crimes case was the same as that which had been investigated in the Palestinian case in 2014.
Monday’s ruling strengthens an earlier ICC ruling that issued arrest warrants against Netanyahu and former Israeli Defense Minister Yoav Gallant for allegedly committing war crimes and crimes against humanity against Palestinians.
Israel rejects the ruling and rejects the ICC’s jurisdiction because Israel is not a signatory to the Rome Statute.
After the appeal was rejected, the Gaza investigation can now continue without obstacles.
Israel has killed nearly 70,700 Palestinians in its brutal aggression in the Gaza Strip.The majority of victims are women and children.
