Because of his actions, the Islamic boarding school caretaker was sentenced to 20 years in prison, with a fine of IDR 5 billion subsidiary six months in prison if he did not pay.
Apart from that, said Jetha, the panel of judges also sentenced the Islamic boarding school’s caretaker to two years of chemical castration and the installation of a detection device.
“The panel of judges sentenced him to 20 years in prison, a fine of IDR 5 billion, subsidiary to 6 months imprisonment. Plus additional penalties for announcements in local and national media as well as chemical castration and installation of detectors on the defendant for 2 years each,” he said.
Jetha said that the judge had considerations to impose a sentence that was heavier than the prosecutor’s demand, namely 17 years in prison. The first is that the judge assesses that the defendant’s actions caused the children or victims to lose their purity.
“The defendant’s actions caused the child victims to experience deep trauma, the defendant’s actions caused deep and prolonged psychological suffering for the victims and the victims’ parents,” he said.
“Then, the judge was of the opinion that the defendant’s actions damaged the future of the victim’s children, the defendant also failed to carry out his obligations as an educator in nurturing, educating, nurturing, developing and protecting the victim’s children,” he added.
The defendant was also considered complicated and made the trial difficult, did not admit & regret his actions. The defendant’s actions have disturbed the community.
“As a result of the defendant’s actions which were carried out using religious symbols, including at the Islamic boarding school that the defendant led, it could tarnish the Islamic boarding school institution, damage the image of the Islamic religion because it used Islamic religious symbols and could cause parents to worry about sending their children to study at the Islamic boarding school. Meanwhile, there are no mitigating considerations,” said Jetha conveying the judge’s considerations.
Jetha said that the implementation of the decision was carried out after the case had permanent legal force.Meanwhile, the prosecutor carries out the execution of criminal decisions.
“The act of chemical castration is carried out after the convict has completed the main sentence, namely imprisonment, regarding the technical implementation of the prosecutor’s domain criminal decision,” he said.
