This was conveyed by Rebekah at the 2025 Socialization of the Administration and Registration of Customary Land for Papua Province at the Auditorium of the Papua Governor’s Office, Jayapura City, last Wednesday (19/11).
Rebekah believes that the existence of customary rights has a strong position constitutionally and in the Papua Special Autonomy Law (UU).He quoted Article 18B paragraph (2) of the 1945 Constitution which confirms the state’s recognition of customary law communities and their traditional rights.Apart from that, the Special Autonomy Law also requires the government to recognize, protect and empower indigenous communities.

“By this we can mean that customary rights are rights that are recognized and respected by the state,” he said.
Furthermore, Rebekah emphasized that Special Autonomy for Papua is an affirmative policy that not only gives special authority to regions, but also ensures partiality for OAP in various aspects of life, including customary land.
Rebekah explained that Law Number 2 of 2021, which regulates the second amendment to the Papua Special Autonomy Law, reaffirms the state’s commitment to Papua’s uniqueness.This policy is realized through the pillars of affirmation, protection and empowerment of OAP.
He explained that various Special Autonomy provisions provide priority space for OAP, starting from the special authority of the provincial/regency/city government, the existence of the Papuan People’s Assembly (MRP) as the cultural representation of OAP, to political affirmation in the form of placing members of the DPRP and DPRK through the appointment route.
Apart from that, added Rebekah, Special Autonomy also allows the formation of ASN which prioritizes OAP and requires the governor and deputy governor to come from OAP.
“(Apart from that) the receipt and use of Special Autonomy Funds, DTI (Additional Infrastructure Funds), and additional DBH (Profit Sharing Funds) are prioritized for OAP,” he explained.
