(56) officially filed an in-depth appeal demanding the hip-hop musician’s immediate release from United States (US) federal prison.
In the latest court documents, P Diddy’s lawyer asked the court to cancel the current sentence or reschedule the sentencing (resentencing).
This step was taken two months after P Diddy gave initial notification regarding plans to appeal the case against him.

, according to documents, Alexandra A.E.Shapiro as the appeal lawyer argued that the 50 month prison sentence received by P Diddy was based on legally flawed considerations.
Diddy’s side accused US District Judge Arun Subramanian of acting as a “13th juror”.They argued that the judge handed down the verdict relying heavily on charges that had been declared unproven by a jury in a previous trial.
For your information, last July, P Diddy was acquitted of serious charges such as sex trafficking and blackmail conspiracy.However, he was found guilty of two lesser serious offense charges, namely transportation for the purpose of prostitution.
“This appeal argues that the district court imposed a record sentence relying on conduct that the jury explicitly rejected. This is in direct conflict with the 2024 Sentencing Guidelines and core constitutional principles,” said P Diddy’s representative in his official statement.
Apart from questioning the duration of the sentence, P Diddy’s legal team also put forward a unique argument based on the First Amendment (right to freedom of expression).They claimed that their client’s position at freak-offs or hotel parties was simply that of an “observer and producer”, not a sexual perpetrator.
They argued that P Diddy was a consumer of the sexual performances he filmed and did not have sex with the people in the videos.However, Justice Subramanian had earlier emphasized that “illegal activities cannot be laundered into constitutionally protected activities just because of the desire to watch them.”
P Diddy has been in custody since his arrest in September 2024. In October 2025, he was transferred to the FCI Fort Dix federal prison in New Jersey.
Based on data from the Federal Bureau of Prisons, P Diddy’s release date is projected to be May 8, 2028. The 50 month sentence he is currently serving is actually lower than the prosecutor’s initial recommendation (70 to 87 months), but much higher than the defense team’s request, which only wanted a maximum of 14 months in prison.
