mentions Government Regulations (PP) regarding member assignments

Yusril said that the issuance of the PP was carried out to resolve legal issues following the Constitutional Court (MK) decision.
He said that this method was also chosen because it would be much faster than having to revise it through Law Number 2 of 2002 concerning the National Police of the Republic of Indonesia (UU Polri).

“The government is currently focused on resolving the problems following the Constitutional Court’s decision and the polemic regarding Perpol Number 10 of 2025 so that it does not spread elsewhere,” he said in a written statement, Sunday (21/12).
“The drafting of a PP will clearly be faster than drafting a law. Therefore, the President chose to regulate it through a PP,” he added.
He explained that later the PP issued by President Prabowo Subianto would regulate any positions related to the police so that they could be filled by National Police personnel.
Yusril said this was in line with Article 19 of Law Number 20 of 2023 concerning ASN which strictly stipulates that certain ASN positions can be filled by TNI soldiers and members of the National Police, with further provisions having to be regulated in Government Regulations.
“The PP that has been drafted is intended to implement Article 28 paragraph (4) of the National Police Law, the decision of the Constitutional Court, as well as Article 19 of the ASN Law,” he said.
He said the process of formulating the PP had also started two days ago involving the Ministry of PANRB, Ministry of State Secretariat and Ministry of Law, under the coordination of the Coordinating Ministry for Law and Human Rights Imipas.The President, he said, had approved the arrangement for the assignment of National Police members to civilian positions to be carried out through the PP.
“It is hoped that by the end of January 2026, the PP will be completed,” he explained.
On the same occasion, Yusril also touched on the position regulations for TNI personnel which are regulated in Law Number 34 of 2004 concerning the TNI.He emphasized that the choice of legal instrument is the policy of the legislator.
“The TNI Law chooses to regulate it directly in law. With the PP there are also no problems. Even though Article 28 paragraph (4) of the National Police Law does not explicitly order further regulation through the PP, based on Article 5 of the 1945 Constitution, the President has the authority to determine the PP to implement the law as it should,” he explained.
On the other hand, Yusril said that decisions regarding the revision of the National Police Law depended entirely on the results of the work of the Commission for the Acceleration of Police Reform, chaired by Jimly Asshiddiqie, as well as the President’s policy direction after receiving recommendations from the commission.
“Whether in the future the National Police Law will be changed or not depends on the results of the work of the Commission for the Acceleration of Police Reform and the President’s policy after the commission completes its work,” he said.
