Yusril: Prabowo’s rehabilitation for North Luwu teachers will not cancel the sentence

emphasized the rehabilitation of President Prabowo Subianto of the two
teacher
in North Luwu only restored their status as ASN, not canceled the criminal decision which had permanent legal force.
“What the President is rehabilitating is his position as a civil servant. Not providing rehabilitation for criminal acts. So he is returning his position as a civil servant,” said Yusril in Makassar, Monday (24/11).
He explained that the dismissal of Rasnal and Abdul Muis as teachers was not included in the Supreme Court (MA) decision.However, he emphasized that the consequences of the Supreme Court’s decision are regulated in the ASN law.

“If the civil servant or ASN is found guilty by a criminal court, then he will be dishonorably dismissed from his position,” he explained.
Yusril then assessed that the dismissal which was claimed to be criminally based by the Governor of South Sulawesi (Sulsel) was in accordance with the court decision which stated that both of them were proven guilty.
“Because he was found guilty of the charges, the Governor dismissed him dishonorably. So the Governor was right, he implemented the ASN law,” he said.
However, Yusril ensured that the two teachers in North Luwu could return to carrying out their professional duties in the education sector as they should.He also confirmed that the rehabilitation process for teachers Rasnal and Abdul Muis after being fired would be completed soon.
“I have given directions to the Governor to immediately reactivate the two teachers concerned. And this morning I received news that steps in this direction had been taken,” said Yusril.
Previously, the Supreme Court (MA) had sentenced the two teachers, Abdul Muis and Rasnal, after they allegedly pocketed Rp. 11 million from the total school committee dues of around Rp. 770 million.
Both are considered to violate Minister of Education and Culture Regulation Number 75 of 2016, which prohibits educators from becoming members of school committees, as well as recording allegations that students who do not pay fees do not receive semester exam cards.
The two teachers were also deemed to have violated Article 11 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended and supplemented by Law Number 20 of 2001 in conjunction with Article 55 paragraph 1 of the Criminal Code in conjunction with Article 64 paragraph 1 of the Criminal Code.
Both are considered to have received gratification.Rasnal and Abdul Muis were sentenced to one year in prison.
