criticized the Head of BNPB Lt. Gen. TNI Suharyanto regarding his statement regarding the ecological disaster on the island of Sumatra in the follow-up hearing on case number: 197/PUU-XXIII/2025 regarding the judicial review of Law Number 3 of 2025 concerning the TNI, Thursday (4/12).
In the session held on Wednesday (3/12), the government was present represented by Deputy Minister of Defense Donny Ermawan and Deputy Minister of Law Edward Omar Sharif Hiariej alias Eddy Hiariej.
Initially, Eddy Hiariej explained that the placement of TNI soldiers in 14 ministries/institutions was based on requests from the heads of the ministries/institutions to the TNI Commander.

“So that the position of TNI soldiers in positions in the 14 ministries or institutions is based on the need to carry out the duties and functions of the relevant ministries/institutions as regulated in Article 47 paragraph 1 of the TNI Law, not based on the TNI’s request,” said Eddy Hiariej.
He explained that before active TNI soldiers are sent to take part in open selection at ministries or institutions as in Article 47 paragraph 1, internal selection must be carried out within the TNI first.
When giving his response, Saldi Isra asked Eddy Hiariej to explain the internal selection mechanism in detail.
On that occasion, Saldi also asked for a sample request letter from the ministry/institution to the TNI Commander regarding the assignment of active soldiers.
“Please also explain how the internal selection mechanism works so that officers or Pati are found who meet the requirements to be sent to certain places,” said Saldi.
He then touched on the statement by the Head of BNPB, Lt. Gen. Suharyanto, who said that the ecological disaster on the island of Sumatra was only popular on social media.
“I actually feel a bit sad about the statement made by a high-ranking officer regarding the disaster in West Sumatra. We are actually thinking about whether this was selected correctly or not. During the disaster, it was said that it was just noise on social media,” said Saldi.
“Well, that’s one of the points, as a person who comes from a disaster area, I need to convey that, as well as to be a reflection for the TNI as well as the Deputy Minister of Defense (Deputy Minister of Defense),” continued the man born in West Sumatra.

Meanwhile, the Head of BNPB, Lt. Gen. TNI Suharyanto, apologized for his viral remarks regarding the disaster in Sumatra which were only popular on social media.
Suharyanto made the apology after inspecting the disaster location in South Tapanuli and seeing the monitoring directly from the air using a helicopter.
“I was surprised, I didn’t expect it to be this big. I didn’t expect it to be this big. I apologize, Mr. Regent. That doesn’t mean we don’t care,” said Suharyanto at a press conference, Monday (1/12).
Material review of the TNI Law
Previously, the Advocacy Team for Security Reform, consisting of dozens of advocates and Human Rights (HAM) activists, became legal representatives for eight applicants in the application for judicial review of Law Number 3 of 2025 concerning Amendments to Law Number 34 of 2004 concerning the Indonesian National Army (TNI) to the Constitutional Court (MK).
The request for a judicial review was a promise made by the advocacy team after the Constitutional Court rejected the request for a formal review of UUTNI on Wednesday, September 17.This request is a continued effort by the civil society movement to reject the expansion of military positions in the civilian realm, TNI impunity, and the extension of the retirement period for TNI generals which has negative consequences for the TNI organization.
The Petitioners in this judicial review request consist of five organizations that actively carry out human rights and democracy advocacy work and actively encourage security sector reform, especially TNI reform, namely Imparsial, the Indonesian Legal Aid Foundation (YLBHI), the Commission for Missing Persons and Victims of Violence (KontraS), the Indonesian Alliance of Independent Journalists (AJI), and LBH APIK Jakarta.
Apart from the organizational applicants, there are also three individual applicants, namely the SETARA Institute lecturer and defense researcher Ikhsan Yosarie and Gadjah Mada University (UGM) students in the names of M. Adli Wafi and M. Kevin Setio Haryanto who are currently active in criticizing and monitoring related to TNI reform.
The coalition views the TNI Law as containing many problems ranging from the formation to the substance contained therein.Therefore, explained Arif, this application targets problematic articles in the TNI Law.
Namely regarding Military Operations Other Than War (OMSP) and the elimination of the DPR’s supervisory function in military operations.
Then there are regulations that allow active soldiers to hold positions in civilian institutions such as the Presidential Secretariat, the National Narcotics Agency (BNN), and the Indonesian Attorney General’s Office.
Furthermore, regarding the retirement age of TNI generals and military justice reform.
