The Civil Society Coalition for Reform of the Criminal Procedure Code will challenge the Criminal Procedure Code Law (

) which has just been ratified by the Constitutional Court (MK).
The coalition will challenge the Criminal Procedure Code to the Constitutional Court if it remains in effect.
“Yes, yes,” said Director of the Indonesian Legal Aid Foundation (YLBHI) Muhammad Isnur, who is part of the coalition, when asked whether the steps he would take included suing the Constitutional Court.

Isnur said the new Criminal Procedure Code has the potential to endanger drug eradication programs and take action against perpetrators of forest destruction.According to him, this regulation also has the potential to target human rights defenders and expand the authority of law enforcement to act without a warrant in urgent situations.
If the Criminal Procedure Code is implemented, investigators, prosecutors or judges can also freeze bank accounts and digital assets during the investigation.
Apart from threatening to sue the Constitutional Court, the coalition will also report to the UN human rights body International Covenant on Civil and Political Rights (ICCPR).
Therefore, the coalition is urging President Prabowo Subianto to cancel or revise problematic articles in the new KUHAP.
“If Prabowo issues a perpu and cancels the law, revises it, of course we will also consider postponing the international report,” he said.
Meanwhile, Deputy Director and Researcher at the Institute for Criminal Justice Reform (ICJR) Maidina Rahmawati said that so far the coalition had found 48 problems in the Criminal Procedure Code, such as incorrect references to articles.
Maidina also highlighted the time lag between ratification and the implementation of the new KUHAP, even though it contains many problems.
The DPR passed the new KUHAP this week.This KUHAP will reportedly come into effect in early January 2026.
