) which prohibits the National Police Chief from giving assignments to
active police
to hold civil office.
Head of the Public Relations Division of the National Police, Inspector General Sandi Nugroho, said that currently his party is still waiting for an official copy from the Constitutional Court regarding the decision.
Sandi said that later the National Police would study the results of the decision issued by the MK.He also ensured that the Bhayangkara Corps would respect and implement the provisions that had been regulated.

“We have not received the decision until now. But the police will always pay attention to the decision that has been made by the court,” he told reporters at PTIK, National Police Headquarters, Thursday (13/11).
On the other hand, Sandi said that the National Police Chief’s assignment of active members to serve outside the Bhayangkara Corps also has conditions and criteria that must be met.
He emphasized that the appointment of police officers to serve in other Ministries and Institutions must be based on the request of the relevant parties and completed with the approval of the National Police Chief as the leader.
“Of course the regulations already exist within the police and have met the criteria that have been determined. Both based on requests from institutions that require the presence of the Police and completed with permission from the Chief of Police,” he said.
“We have seen that there is a decision today, we are just waiting to see what the concrete decision is so that we can see and learn what the police have to do,” he added.
Previously, the Constitutional Court stated that if a police officer wants to hold a civil position, he or she must resign or retire from their position.
In this case, the Constitutional Court granted the entire petition in case number: 114/PUU-XXIII/2025 which was petitioned by Syamsul Jahidin (student/advocate) and Christian Adrianus Sihite (student) who tested the constitutionality of the norms of Article 28 paragraph (3) and the Explanation of Article 28 paragraph (3) of Law 2/2002 concerning the Police (UU Polri).
“Granting the Petitioners’ petition in its entirety,” said Chief Justice of the Constitutional Court Suhartoyo when reading out the verdict in the MK courtroom, Thursday (13/11).
Meanwhile, the Elucidation to Article 28 paragraph (3) states “What is meant by ‘positions outside the police’ are positions that are not related to the police or are not based on an assignment from the National Police Chief.”
“Substantially, these two provisions emphasize one important thing, namely that members of the National Police can only hold positions outside the police after resigning or retiring from the police service,” said Constitutional Justice Ridwan Mansyur.
“This means that, if understood and interpreted appropriately and correctly, ‘resigning or retiring from the police service’ is a requirement that must be fulfilled by members of the National Police to hold positions outside the police,” he continued.
