MUI Tax Fatwa: Government Must Evaluate PBB, PPh and PKB Burden

Indonesian Ulema Council (
MUI
) establishes a fatwa for
tax
fair, as a response to social problems that arise as a result of an increase in land and building tax (PBB) which is considered unfair, thus disturbing the community.
Head of the MUI Fatwa Division, Asrorun Niam Sholeh, said that tax objects are only imposed on assets that can be used for productivity and/or are secondary and tertiary needs, not basic needs such as basic necessities or housing.
“So levying taxes on things that are basic needs, such as basic necessities and houses and the land we live on, does not reflect justice and the purpose of taxes,” he said at the XI MUI National Conference in Jakarta, citing

This, he said, is because in essence, taxes are only imposed on citizens who have financial means.
“If it is analogous to zakat obligations, according to Sharia, financial capacity is at least equivalent to the zakat mal nisab, namely 85 grams of gold. This could be the PTKP (Non-Taxable Income) limit,” he said.
MUI recommendation: PBB, PPh and PKB must be evaluated
Therefore, the MUI made a number of recommendations, such as reviewing the tax burden, especially progressive taxes whose value is felt to be too large.
“The Ministry of Home Affairs and regional governments are evaluating regulations regarding value added tax (PPn), income tax (PPh), land and building tax (PBB), motor vehicle tax (PKB), inheritance tax which are often increased just to increase regional income without considering the community’s sense of justice,” he said.
This, he said, is to ensure that tax charges are adjusted to the taxpayer’s capabilities, in order to realize fair and equitable taxation.
“The government must optimize the management of state wealth resources and crack down on tax mafias in order to maximize public welfare,” he said.
Apart from that, he said, the government and the DPR are obliged to evaluate various statutory provisions related to unfair taxation and use this fatwa as a guide.
He said the government was obliged to manage taxes in a trustworthy manner and use this fatwa as a guideline.
“The public needs to comply with the tax payments required by the government if they are used for public benefit,” he said.
