MK Judge Arsul Sani Complained by Bareskrim about Fake Diplomas, MKMK Responds

MKMK Chairman I Gede Dewa Palguna admitted he was surprised by the report.According to him, the reporter should first ask the DPR RI as the institution that carried out the fit and proper test for Arsul Sani to become a Constitutional Court judge.
“I, and we at the MKMK, feel that it is a bit strange why you suddenly went to Bareskrim? Mr. Arsul is a constitutional judge who was proposed by the DPR. So, if there are allegations of the use of fake diplomas, this indirectly means that the complainants doubt the results of the fit and proper test conducted by the DPR. Palguna also touched on Article 20 of the Constitutional Court Law which states every judge is selected objectively, transparently and the selection mechanism depends on the nominating institution.
Therefore, said Palguna, the accusation regarding Arsul’s fake diploma should have been asked of the DPR first.
“Therefore, logically, ask the DPR first. Remember, Article 20 of the Constitutional Court Law states that constitutional judges are selected objectively, transparently and accountably and the selection mechanism is handed over to each state institution that has the authority to nominate constitutional judges (DPR, President, Supreme Court),” he said.
Palguna revealed that MKMK had been investigating the developing issue regarding the accusations against judge Arsul Sani for almost a month.
However, Palguna said that the process carried out by MKMK could not be conveyed to the public to ensure that related parties were not judged on issues whose truth was not yet clear.
“In relation to the MKMK, since this issue emerged approximately a month ago, we at the MKMK have studied it. Because, the MKMK’s task is not only to enforce the code of ethics and behavioral guidelines for judges, but also to maintain the dignity and honor of constitutional judges,” said Palguna.
“Regarding where we are working, we are sorry, we cannot mention this at this time. Apart from the fact that (according to the PMK) this must be done behind closed doors, it is also so that the constitutional judge concerned is not ‘tried’ by questions or issues that are not yet clear,” he continued.
Previously, the Alliance of People Observing the Constitution complained about constitutional judge Arsul Sani to the Police Criminal Investigation Unit regarding the legality of Arsul Sani’s doctoral program diploma which was allegedly fake.
“We from the Constitution Observer Community Alliance today visited the National Police Headquarters Criminal Investigation Unit in order to report one of the Constitutional Court judges with the initials AS who is suspected of having or using a fake diploma,” said the Coordinator of the Constitution Observer Community Alliance, Betran Sulani, to journalists at the National Police Criminal Investigation Unit, South Jakarta, Friday (14/11).
Contacted separately, Arsul Sani stated that he was reluctant to engage in polemics regarding accusations of fake diplomas.He only said that this matter was also now being handled by the MKMK.
“As a judge, I am bound by a code of ethics not to engage in polemics. This matter is also handled by the MKMK,” he said.
Meanwhile, member of Commission III DPR RI, Soedeson Tandra urged Arsul Sani as a public official to explain to the public about the allegations of fake diplomas circulating.
“Well, it’s like this, he’s a public official. If there is doubt, that’s a form of transparency, so he has to reveal and explain to the public. Explain to the public what is suspected, yes, he has to explain,” said Tandra when contacted, Sunday (16/11).
According to him, clarification to the public is a form of accountability.He talked about the long process of getting a doctorate.
