Malaysia Rejects Former PM Najib Razak’s Request to Be Under House Arrest

High Court Judge Alice Loke Yee Ching ruled that Najib’s claim regarding former Malaysian King Sultan Abdullah Ri’ayatuddin Al-Mustafa Billah Shah’s additional order for house arrest was invalid and unenforceable.

He said the existence of additional royal orders was not disputed.However, this was not decided at the 61st Pardons Board meeting in January last year when the board agreed to reduce Najib’s sentence.
Najib’s claim regarding the former king’s orders also does not follow the requirements stated in Article 42 of the Federal Constitution, namely when the Yang Dipertuan Agong issued an additional order or addendum to place Najib under house arrest.
“The additional order was not discussed or decided at the 61st Pardon Board meeting. There is no compliance with Article 42, therefore the order is invalid,” he said on Monday (22/12), quoted

Furthermore, Alice explained that this meant that the Malaysian government had no obligation to enforce the house arrest order.
After the ruling, Najib’s lead lawyer, Muhammad Shafee Abdullah, told the High Court that his client would appeal the decision.
Najib began applying for house arrest in April 2024 after his sentence was cut in half.
The Pardon Board, headed by the king, announced the reduction of Najib’s sentence on February 2 last year.
He claimed that the former king of Malaysia issued an additional order allowing him to serve the remainder of his sentence under house arrest.
Najib began serving his prison sentence in August 2022 after being found guilty of three counts of breach of trust, three counts of money laundering and one count of abuse of power.
The charges relate to the transfer of RM42 million from SRC International, a former subsidiary of 1Malaysia Development Berhad (1MDB) to a personal bank account in 2014-2014.
1MDB is a state investment fund founded by Najib in 2009.
At the time the funds flowed, he was serving as prime minister.Najib was PM of Malaysia from 2009 to 2018.
As a result of these actions, the court sentenced Najib to 12 years in prison and a fine of RM210 million.However, the then King of Malaysia, Sultan Abdullah Ri’ayatuddin reduced the sentence to six years in prison and a fine of RM50 million just before stepping down on January 30, 2024.
