SMA 72 Jakarta

LPSK Deputy Chair Susilaningtias said that the recovery of child victims is the main priority that LPSK can carry out.Because recovery is not just physical, but also mental, and the sustainability of the child’s future.
“The most important thing is to ensure that children do not endure this trauma alone. The state must be present to provide comprehensive protection,” said Susilaningtias in his statement, Thursday (27/11).

Susilaningtias explained that the application was related to the criminal act of intentionally causing an explosion and/or a situation that endangered the lives of other people, as regulated by Article 355 of the Criminal Code, Article 187 of the Criminal Code, and Article 1 paragraph (1) of the Emergency Law Number 12 of 1951 concerning Firearms and Explosives.
Therefore, he said, the explosion incident at SMA 72 was included in the category of other criminal acts that threatened life safety as regulated in the Witness and Victim Protection Law.
“This means that, even though this case is not included in a group of special criminal acts such as terrorism, the threat to the victim’s life is a strong legal basis for the victim to receive LPSK protection,” he said.
Apart from that, because the majority of victims were children, the provisions in Law Number 35 of 2014 concerning Child Protection were also applied.
The law stipulates that child victims have the right to protection and restitution, namely compensation paid by the perpetrator for the losses suffered by the child.
Therefore, LPSK emphasized that all child victims in this case have the right to have their requests for restitution processed according to the losses incurred.
The form of protection proposed by Polda Metro Jaya is in the form of calculating restitution and providing protection in the form of assisting victims in undergoing the legal process.
Regarding this matter, Susilaningtias said that his party would calculate restitution or the value of the losses experienced by each victim which would be charged to the perpetrator in accordance with the mandate of PP Number 7 of 2018 which was amended into PP 35 of 2020 concerning compensation for victims of criminal acts.However, in the case of child perpetrators, the responsibility for paying restitution can be paid through a third party.
“Restitution is the child’s right as a victim. The value will be calculated based on the actual losses experienced, including medical, psychological costs and suffering experienced by the victim. In the case of child perpetrators, restitution can be paid by a third party in accordance with legal provisions. LPSK’s focus is to ensure that this right is received by every child victim,” said Susilaningtias.
The explosion occurred at SMAN 72 North Jakarta, Friday (7/11) at around 12.15 WIB, in the school mosque area during Friday prayers.
There were no fatalities in the incident.However, 96 people were injured in the incident.
Spokesperson for Densus 88 Anti-terror Police AKBP Mayndra Eka Wardhana stated that the explosion at SMA 72 Kelapa Gading, North Jakarta was not terrorism.This action is called a general criminal act.
“There was no finding of any terrorist activity carried out by ABH (children in conflict with the law). So the actions carried out were purely general criminal acts,” he said at a press conference, Tuesday (11/11).
