“To judge: sentence the defendant to 11 years imprisonment and a fine of IDR 500 million,” said the chairman of the panel, Efendi, when reading out the verdict at the Jakarta Corruption Court, Wednesday (3/12).
Apart from the chairman of the panel, Efendi, this case was examined and tried by member judges Adek Nurhadi and Andi Saputra.
Djuyamto was also sentenced to an additional sentence in the form of an obligation to pay compensation amounting to Rp. 9.21 billion, subsidiary to 4 years in prison.
Meanwhile, Agam and Ali Muhtarom were sentenced to pay compensation amounting to IDR 6.4 billion.
If you cannot pay the replacement money no later than 1 month after the decision has permanent legal force, then your property can be confiscated by the prosecutor and auctioned off to cover the replacement money.
“And in the event that the convict no longer has sufficient assets to pay replacement money, then it will be replaced by imprisonment for 4 years,” said the judge.
Djuyamto et al were declared to have been legally and convincingly proven guilty of committing the criminal act of corruption and receiving bribes together as punishable by Article 6 paragraph 2 in conjunction with Article 18 of the Corruption Eradication Law (UU Tipikor) in conjunction with Article 55 paragraph 1 1 of the Criminal Code.
Djuyamto was proven to have received bribes amounting to IDR 9,211,864,000.Meanwhile, Agam Syarief and Ali Muhtarom received IDR 6,403,780,000 each.
Meanwhile, former South Jakarta District Court Chairman Arif Nuryanta was proven to have received a bribe of IDR 14,734,276,000 and North Jakarta District Court Junior Civil Registrar Wahyu Gunawan received IDR 2,365,300,000.Arif and Wahyu’s verdict will also be read out tonight.
In handing down the criminal decision, the prosecutor considered a number of aggravating and mitigating factors.
The burdensome thing is that the actions of Djuyamto et al do not support the state’s commitment to realizing a government that is clean and free from corruption, collusion and nepotism.
The actions of the defendants have tarnished the reputation of the judiciary as the last bastion of justice.
The defendants as law enforcers committed criminal acts in their position while adjudicating corruption cases. The actions of the defendants were not because of need but because of greed.
Meanwhile, the mitigating factor is that the defendants have returned the bribes they received and have family responsibilities.
This sentence was lighter than the demands of the Public Prosecutor (JPU) who wanted Djuyamto, Agam and Ali Muhtarom to be sentenced to 12 years in prison and a fine of IDR 500 million, subsidiary to 6 months in prison.
