The panel of judges assessed that the defendant Julham Situmorang was believed to be proven guilty of illegally collecting parking fees at Vita Insani Hospital from May to July 2024, worth IDR 48.6 million.

“The defendant’s actions violated Article 11 in conjunction with Article 18 of Law Number 20 of 2001 concerning the eradication of criminal acts of corruption in conjunction with Article 55 paragraph (1) 1 of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code,” he said.
Apart from imprisonment, the panel of judges also sentenced the defendant to pay a fine of IDR 50 million with the provision that if the fine is not paid, it will be replaced by imprisonment for two months.
The panel of judges did not impose a penalty on compensation because the defendant had deposited the entire collection amount of Rp. 48.6 million into the regional treasury of the Pematangsiantar City Government.
In its considerations, the panel of judges stated that the aggravating factor was that the defendant’s actions were contrary to the government’s efforts to eradicate corruption.
Meanwhile, as a mitigating factor, the defendant has served as a state civil servant for 29 years, has family responsibilities, and has never been convicted.
After reading the verdict, Chief Judge Kasim gave seven days to the Pematangsiantar Prosecutor’s Office (Public Prosecutor) and the defendant to express their position on the verdict.
“The defendant and public prosecutor were given seven days to express their position, whether to appeal or accept this verdict,” he said.
This sentence was lighter than the demands of the Pematangsiantar Prosecutor’s Office, who previously charged the defendant with imprisonment for four years and six months.
Public prosecutor Kurniawan Sinaga said the defendant was also charged with paying a fine of IDR 200 million, with the stipulation that if the fine was not paid, it would be replaced by three months’ imprisonment.
“The defendant’s actions have fulfilled the elements of the primary indictment, namely Article 12 letter e in conjunction with Article 18 of Law Number 20 of 2001 concerning the eradication of criminal acts of corruption in conjunction with Article 55 paragraph (1) 1 of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code,” he said.
