The DKI Jakarta High Court (PT) has increased the sentence of the former Head of the DKI Jakarta Cultural Service (Kadisbud).

to 12 years in prison from the original 11 years.
The panel of appeals judges assessed that Iwan had been legally and convincingly proven guilty of committing criminal acts of corruption in fictitious art activities in the service he led in the period from January 2022 to December 2024 as stated in the primary indictment of the public prosecutor.
“Sentenced the defendant Dr. Iwan Henry Wardhana in the form of imprisonment for 12 years and a fine of IDR 500 million with the provision that if it is not paid, it will be replaced by imprisonment for 6 months,” said the appeal decision, quoted on Sunday (21/12).

Not only that, the compensation penalty for Iwan was also increased from the original Rp. 13,535 billion to Rp. 20 billion (Rp. 20,507,199,844.00).
If Iwan does not pay the replacement money no later than 1 month after the court decision becomes legally binding, then his property can be confiscated by the prosecutor and auctioned off to cover the replacement money.
“In the event that the defendant does not have sufficient assets to pay compensation, he will be sentenced to 6 years in prison,” said the judge.
The judge determined that the period of Iwan’s arrest and detention was deducted entirely from the sentence imposed.The judge also determined that Iwan would remain in custody.
“Charging the Defendant court costs at two levels of court, at the appeal level, amounting to IDR 2,500,” said the judge.
The decision in case number: 62/PID.SUS-TPK/2025/PT DKI was examined and tried by the chairman of the panel, Teguh Harianto, with member judges Budi Susilo and Hotma Maya Marbun.Substitute Registrar Effendi P. Tampubolon.The verdict was read out in a trial which was open to the public on Thursday, December 18 2025.
Legal considerations
Regarding the crime charged against Iwan, the panel of appeals judges did not agree with the court of first instance or the Public Prosecutor (JPU).
This is because Iwan, as Head of the DKI Jakarta Provincial Culture Service, does not carry out the functions and duties according to the oath of office he holds.
In fact, the crime occurred starting from Iwan’s actions in dragging the other defendants.In other words, Iwan was the motor behind the crime.
Iwan is also considered to have made no effort to recover state losses due to the criminal acts of corruption he committed.In the midst of concerns about state money, Iwan actually went on a spree in misappropriating state money.
Regarding the amount of replacement money, the PT DKI panel of judges agreed with the prosecutor.
In the facts of the trial, Iwan received an amount of Rp. 15,700,000,000 from witness Gatot Arif Rahmadi and from witness Ni Nengah Sutiarsih an amount of Rp. 500,000,000.
Iwan ordered a sum of money from the activities budget for the 2022-2024 Fiscal Year of the DKI Provincial Culture Service in the amount of IDR 4,307,199,844 for New Year’s money, THR, munggahan events, fitness activities and pocket money for purchasing flowers.
“Considering these considerations, the decision of the Central Jakarta District Court Number: 56/Pid.Sus-TPK/2025/PN Jkt.Pst dated 30 October 2025 must be changed regarding the length of the sentence, the amount of compensation money and evidence,” said the judge.
“Based on the provisions of Article 222 paragraph (1) of the Criminal Procedure Code, for defendants who are proven guilty and sentenced to a crime, the defendant is burdened with the obligation to pay court costs at two levels of justice, the amount of which will be determined in the verdict,” he continued.
