The Situbondo Public Prosecutor charged Masir with Article 40 B paragraph 2 letter B in conjunction with Article 33 paragraph 2 letter G Law of the Republic of Indonesia number 32 of 2024 in conjunction with Law number 5 of 1990 concerning the conservation of biological natural resources and their ecosystems.
After being sentenced to two years in prison, in the video circulating, Masir was seen crying hysterically and looking down.This case went viral on social media and invited a lot of public sympathy for Masir.Now the handling of the case has been taken over by the East Java High Prosecutor’s Office (Kejati).

“The handling of this case has been carried out by the Situbondo District Prosecutor’s Office. And at the last trial on December 4 2025, the prosecution was carried out by the Situbondo Public Prosecutor with a demand of 2 years in prison,” said Deputy Head of the East Java High Prosecutor’s Office, Saiful Bahri Siregar, Thursday (18/12).
Saiful said that the trial facts revealed that the defendant had carried out similar actions five times in Baluran National Park.Masir was arrested, but released and not prosecuted.
During his sixth action, Masir was apparently caught by Baluran National Park officers carrying five shrike birds.This latest action was finally prosecuted.
“This area is an area where it is prohibited to take anything from inside,” he said.
“And the defendant has done this repeatedly, namely six times, in accordance with the facts of the trial which were revealed in the trial facts. So the KSDA officials, both the KSDA, handed it over to investigators for follow-up and currently the prosecution process is at trial,” he said.
Today, said Saiful, the prosecutor will submit the public prosecutor’s response or reply regarding the defense note from the defendant’s legal advisor.The East Java High Prosecutor’s Office (Kejati) took over the case.
“So today we will take over, take over the charges and they will be read out today, they will be read out in court regarding the takeover of the contents of the criminal charges. Later they will be read out in court,” he said.
Meanwhile, in the hearing scheduled to read the replica at the Situbondo District Court (PN) today, Public Prosecutor Huda Hazamal submitted a change in the charges against the defendant Masir.From the previous two years in prison, he became six months in prison.
The prosecutor said that Masir was proven to have violated the charges of Article 40B paragraph (2) letter b in conjunction with Article 33 paragraph (2) letter g of Law Number 32 of 2024 concerning amendments to Law Number 5 of 1990 concerning Conservation of Living Natural Resources and their Ecosystems.
In this reply, the prosecutor still asked the panel of judges to impose a sentence of six months in prison, reducing the prison term already served, and asked the defendant to remain in detention.
“The defendant was proven to have taken five shrike birds and this act had the potential to damage the ecosystem in the Baluran National Park area,” said Huda.
