House of Representatives (DPR)
officially ratified the Draft Criminal Procedure Code (
RKUHAP
) became law, Tuesday (18/11).
The decision was taken at the 8th Plenary Meeting for the 2025-2026 second session chaired by the Chair of the Indonesian House of Representatives, Puan Maharani.Also present were Deputy Speaker of the DPR Sufmi Dasco Ahmad, Adies Kadir, Saan Mustafa, and Cucun Ahmad Syamsurijal.
“Can the Draft Criminal Procedure Code be approved to become law,” said Puan in a meeting at the Parliament Complex, Senayan, Jakarta.

“Agreed,” said the DPR members present.
This plenary session was only attended in person by 242 members and 100 people online out of 579 total DPR members.The rest were absent.
The second level decision-making meeting was held after the RKUHAP had previously been approved by eight factions in the DPR Commission III Working Committee (Panja) on Thursday (13/11).
All factions agreed to pass the RKUHAP into law.They believe that the RKUHAP must be updated immediately because it is already 44 years old since it was first passed in 1981 under President Soeharto.
Some of the substances in the changes to the Criminal Procedure Code through this revision include, among others, adjusting the criminal procedural law to the new Criminal Code, improving the authority of investigators, investigators and prosecutors, strengthening the rights of suspects and defendants, and strengthening the role of advocates.

“The RKUHAP must ensure that every individual involved, whether as a suspect or victim, continues to receive fair and equal treatment,” said Chairman of Commission III of the DPR, Habiburokhman.
Even so, the Civil Society Coalition for KUHAP Reform rejects the plan to ratify the RKUHAP.They consider the process of discussing the RKUHAP to be formally and materially flawed.
They also reported the 11 Working Committees (Panja) of the bill to the DPR’s Council of Honor (MKD), Monday (17/11) for alleged violations of the code of ethics related to drafting laws as regulated in the MD3 Law.
The coalition took issue with the process of drafting the RKUHAP which was deemed not to fulfill the elements of public participation.They also accused it because the coalition’s name was thought to have been used in drafting the bill.
“We reported eleven people, leaders and members of the Panja from elements of the DPR RI related to the discussion of the RKUHAP,” said the Director of the Jakarta Legal Aid Institute (LBH) Fadhil Alfathan.
