) admits that he is reviewing the regulations on the decision of the Constitutional Court (

) regarding the placement of National Police members outside the police agency.
“Yes, regarding the Constitutional Court’s decision, of course, the Corruption Eradication Commission as an institution is currently conducting a study through its Legal Bureau,” said Acting Deputy for Enforcement and Execution of the Corruption Eradication Committee, Asep Guntur Rahayu.
Apart from the KPK study, Asep also revealed that his agency will wait for studies from other institutions related to the Constitutional Court’s decision, including related ministries.

“What kind of study will be carried out, not only at the Corruption Eradication Commission, I think, also at ministries, institutions that employ members of the National Police, will definitely also be conducting studies like that,” he said.
Furthermore, Asep said to wait for the results of the study, while emphasizing the importance of communication.
“Later, we will wait together to see what the study will be like, regarding the Constitutional Court’s decision, but what is clear is that whatever the outcome, I and my colleagues are still brothers, I and my colleagues are still friends, whenever and wherever we can chat with each other, discuss each other like that, yes, like that,”
Previously, the Constitutional Court granted all petitions in case number: 114/PUU-XXIII/2025 filed by Syamsul Jahidin (student/advocate) and Christian Adrianus Sihite (student) who tested the constitutionality of the norms of Article 28 paragraph (3) and the Elucidation of Article 28 paragraph (3) of Law 2/2002 concerning the Police (UU Polri).
Article 28 in the decision states that what is meant by positions outside the police are positions that are not related to police duties and are not assignments from the National Police Chief.
“Substantially, these two provisions emphasize one important thing, namely that members of the National Police can only hold positions outside the police after resigning or retiring from the police service,” said Constitutional Justice Ridwan Mansyur.
For information, the National Police Headquarters said that the number of active members outside the Bhayangkara Corps institution is 300 people.
Head of Public Relations Division of the National Police, Inspector General Sandi Nugroho, said the hundreds of members were spread across various ministries and related institutions.
“There are around 300 people [members holding civil positions],” Sandi told reporters at Police Headquarters, Monday (17/11).
