Commission III Denies NGO Profiteering: RKUHAP Only Has 99.9% Public Input

“100 percent, maybe 99.9 percent of the new Criminal Procedure Code is input from civil society, yes. Especially in strengthening the role of advocates and suspects’ rights as a mechanism to control so that law enforcement officers do not commit arbitrariness, yes,” said Habib at the Parliament Complex, Senayan, Jakarta, Tuesday (18/11).
Habib denied that his party was said to have used the names of Non-Governmental Organizations (NGOs) during the discussion of the RKUHAP.He confirmed that he had invited and absorbed the aspirations of a number of NGOs and professional organizations in the last few months.
The Gerindra Party politician said that discussions on the RKUHAP were actually completed in July 2025.However, due to many pressures, his party has reopened the agenda for hearings with civil society.
“We are reopening input from the community, right, from July, August, September, October, November, early November, until almost 100 community groups attended, including several NGOs, a group of NGOs calling themselves the Civil Society Coalition and so on,” he said.
According to him, based on input from civil society, the secretariat team created a clustering to be presented at the working committee meeting.He gave the example of a proposal to remove the ban on reporting in court from the Alliance of Independent Journalists (AJI).
Apart from that, said Habib, there is also a proposal from the Institute for Criminal Justice Reform (ICJR) regarding expanding pretrial objects, including the issue of abandoning reports to suspending detention.
“From several points, we accommodated these two, we included them in the articles related to pre-trial objects. Likewise, input from the University of Indonesia was conveyed by my friend, colleague Taufik Basari. He teaches at the University of Indonesia, sent a letterhead, the existing letter used UI letterhead, including the question of prohibiting torture and intimidation during examinations. A total of eight or all factions in Commission III of the DPR agreed that the RKUHAP would immediately be passed into law in plenary.
Some compact factions believe that the RKUHAP must be updated immediately because it is already 44 years old since it was first passed in 1981 under President Soeharto.
Some of the substances in the changes to the Criminal Procedure Code through this revision include, among others, adjusting the criminal procedural law to the new Criminal Code, improving the authority of investigators, investigators and prosecutors, strengthening the rights of suspects and defendants, and strengthening the role of advocates.
Even so, the Civil Society Coalition for KUHAP Reform rejects the plan to ratify the RKUHAP.They consider the process of discussing the RKUHAP to be formally and materially flawed.
They also reported the 11 Working Committees (Panja) of the bill to the DPR’s Council of Honor (MKD), Monday (17/11) for alleged violations of the code of ethics related to drafting laws as regulated in the MD3 Law.
