) requested that the death penalty be revoked or withdrawn in past narcotics criminal cases

In a follow-up meeting on the bill, JRKN representative Ma’ruf Bajammal assessed that Indonesia should no longer impose the death penalty in narcotics crimes.

“We see that the death penalty option was reintroduced during previous discussions in the Criminal Adjustment Bill,” said Ma’ruf in his presentation.
He gave a number of reasons for his proposal.First, JRKN, said Ma’ruf, found data that stated that 63 percent of those sentenced to death were convicts for narcotics cases.During the 2015-2016 period, 18 or all of the death sentences were for narcotics cases.
Second, Ma’ruf believes that the government should act fairly towards Indonesian citizens who are threatened with the death penalty.Not only abroad, but also for domestic convicts.Because, in fact, 111 of the 156 Indonesian citizens who are threatened with the death penalty abroad are convicted of narcotics cases.
However, the government’s advocacy and defense is only carried out at the international level, not for convicts who are also threatened domestically.
“However, this should also run linearly within the country; not just government advocacy at the international level,” said Ma’ruf.
Third, Indonesia is one of the countries that has ratified the International Covenant on Civil and Political Rights (ICCPR).In this covenant, the right to life is a right that cannot be reduced.
“If we look at the provisions in the ICCPR itself, the death penalty may indeed be imposed but with strict conditions and that is only for the most serious crimes,” he said.
Finally, the UN Human Rights Committee, continued Ma’ruf, has interpreted that countries should abolish the death penalty.The committee has also interpreted that narcotics crimes are not included in the most serious criminal category or
the most serious crimes

particularly serious
.
“What does that mean? Narcotics policies that are inappropriate or inappropriate can be subject to the death penalty if we refer to the norms of international legal instruments which we also view as national legal norms, because we have ratified them,” he said.
