Meanwhile, Iskandar was obliged to pay compensation of more than Rp. 7 billion that had been deposited previously.
The panel of judges stated that the two defendants were proven to have accepted bribes totaling more than IDR 67 billion related to securing and arranging various project packages for a number of services in the Langkat Regency Government.
Defendant Terbit gave directions to the department head regarding the winner of the work, while defendant Iskandar arranged the distribution of project packages and the amount of deposits.
“The actions of the two defendants were proven to have violated Article 12 letter i, and Article 12B in conjunction with Article 18 of the Republic of Indonesia Law Number 20 of 2001 concerning the Eradication of Corruption Crimes in conjunction with Article 55 paragraph (1) 1 in conjunction with Article 65 paragraph (1) of the Criminal Code,” he said.
The panel of judges said that the burden was that the defendants had not returned all state losses, they had not paid attention to regional development, and the defendant had previously committed a crime of corruption.
Defendant Terbit was also uncooperative and gave a complicated statement at trial.Meanwhile, mitigating factors include the polite attitude of the defendants, remorse, and family responsibilities.
After reading the verdict, Chief Judge As’ad Rahim Lubis gave the defendants and the KPK prosecutor seven days to express their position on the verdict.
“The defendants and public prosecutor were given time to think about whether to file an appeal or accept this verdict,” said As’ad.
This sentence was lighter than the demands of KPK prosecutor Dwi Junianto, who previously asked that the two defendants be sentenced to five years in prison each, pay a fine of Rp. 500 million each, if not paid, it would be replaced by six months’ imprisonment.
