Austria

The bill, proposed earlier this year, was seen as an attempt to protect girls “from oppression”.
“When a girl is told that she must cover her body to protect herself from the gaze of men, it is not a religious ritual, but rather oppression,” said Integration Minister Claudia Plakolm when presenting the bill.
Plakolm said the ban on wearing the hijab, including the burqa, would take effect from the start of the new school year in September.
In February, outreach will be carried out with teachers, parents and students. The initial implementation of the rules will then apply, without sanctions for those who violate.
However, if the violation occurs repeatedly, the student’s parents will be fined from 150 to 800 euros (around Rp. 3-15 million).
Human rights organizations have criticized the bill as “an expression of anti-Muslim racism”.
“[The ban] constitutes blatant discrimination against Muslim girls,” Amnesty International Austria said in a statement, as quoted
AFP
.
Amnesty warned the policy risks “exacerbating existing prejudices and stereotypes against Muslims.”
Likewise, the Muslim community in Austria, IGGOe, also considers this ban to “harm social cohesion” and actually stigmatizes and marginalizes Muslim children, instead of empowering them.
Meanwhile, according to the Freedom Party (FPOe), Austria’s extreme right-wing party, this ban is still not enough because it does not cover all students, teachers and staff.
In 2019, Austria banned the hijab in elementary schools (SD).The Constitutional Court (MK) then canceled the prohibition law because it was considered unconstitutional and discriminatory.
The current government coalition believes that this bill will not be canceled because it guarantees children’s rights.
However, constitutional law expert Heinz Mayer doubts that this ban can be considered constitutional considering that the Constitutional Court stated in 2020 that “one religion is being discriminated against” through this law.
