(US) changed the H-1B work visa selection mechanism by prioritizing
foreign workers
who receive higher wages and have more advanced skills.
This new rule replaces the random lottery system that has been used in determining H-1B visa recipients.
The policy change was announced by the Department of Homeland Security (DHS) through an amendment to the regulations governing the H-1B work visa selection process.In the latest regulations, visa allocation will be carried out through a weighted selection system that provides greater opportunities for high-paid and skilled foreign workers.

US Citizenship and Immigration Services (USCIS) spokesman Matthew Tragesser said the random lottery system was previously often misused by some companies in Uncle Sam’s country.
“The random selection process for H-1B registration has been exploited and abused by US companies who primarily want to bring in foreign workers at lower wages than American workers,” he said in an official statement, Tuesday (23/12).
According to Tragesser, a weighted selection mechanism would be more in line with Congress’ goals in the H-1B program and strengthen US competitiveness.
“The new weighted selection will better serve the original goals of the H-1B program and strengthen America’s competitiveness by encouraging companies to apply for foreign workers with higher wages and skills,” he said.
The number of H-1B visas issued each year remains limited to 65 thousand visas, with an additional 20 thousand visas for graduates with advanced degrees from universities in the United States.So far, the random lottery system is considered to provide a loophole for the practice of recruiting low-wage foreign workers which is detrimental to the domestic workforce.
Through this final rule, visa allocation opportunities will be increased for high-skilled and salaried foreign workers, while still providing opportunities for companies to recruit H-1B workers at various wage levels.
This rule will take effect on February 27, 2026 and be implemented in the fiscal year 2027 H-1B application season.
This policy change is part of the US government’s efforts to strengthen the integrity of the H-1B nonimmigrant visa program.The move is in line with other government policies, including a presidential proclamation requiring companies to pay an additional US$100 thousand per visa as a condition of eligibility.
“As part of the Trump Administration’s commitment to H-1B reform, we will continue to demand more from foreign companies and workers to avoid harming American workers and keeping America’s interests first,” Tragesser said.
